Terms and Conditions – Traveller & Trespasser Instructions
These Terms and Conditions apply to all instructions given to UK Bailiff Services Limited, trading as UK Bailiffs(“UKB”).
- Parties. These Terms and Conditions apply to all instructions given to UK Bailiff Services Limited, trading as UK Bailiffs(“UKB”).
- Acceptance of Terms. You, the Client / Claimant, agree to be bound by these Terms and Conditions upon submitting or signing an Instruction Form or otherwise instructing UKB.
- Right to Decline Instructions. UKB reserves the right to decline, suspend or discontinue any instruction at its absolute discretion and without providing a reason.
- Client Authority to Instruct. By instructing UKB, the Client confirms that they have the legal right and authority to instruct UKB in respect of the land or premises concerned, whether as landowner, lawful occupier, authorised agent or legal representative.
- Verification of Authority. UKB reserves the right to carry out reasonable checks to verify the Client’s authority, including (without limitation) Land Registry searches, title document reviews, authority letters or agency confirmations. Failure to provide satisfactory evidence may result in delay, suspension or refusal of the instruction.
- Scope of Services. Unless expressly agreed otherwise in writing, UKB is authorised to attend the site and take such lawful steps as are necessary to request vacation of land by trespassers or unauthorised occupiers in accordance with the Client’s instruction.
- Method of Instruction. All instructions must be submitted electronically. UKB will not accept instructions verbally or by post unless expressly agreed by a Director.
- No Legal Advice. UKB is not a firm of solicitors and does not provide legal advice. Any information provided is operational or procedural in nature only.
- Client Responsibility for Decisions. UKB accepts no liability for decisions taken by the Client or for any loss or damage arising from reliance on information provided by UKB, its agents or contractors.
- Limitation of Liability. UKB shall not be liable for any loss of income, loss of profits, loss of reputation, loss of opportunity, or for any indirect, incidental or consequential loss or damage arising howsoever caused.
- Fees, Deposits and Disbursements. UKB will invoice the Client for all fees, costs and disbursements associated with the instruction. Where a deposit is taken, UKB reserves the right to retain all or part of the deposit to cover fees, attendance costs, abortive work or disbursements incurred.
- Disbursements.
Disbursements may include, but are not limited to:
- Parking charges
- Toll charges
- Congestion Zone charges
- ULEZ or other clean air zone charges
- Travel, accommodation or subsistence costs where applicable
- Third-party costs reasonably incurred in the course of the instruction
All disbursements are chargeable at actual cost and payable by the Client. - Payment Terms. Invoices must be paid within the timescale stated. Where an invoice is disputed, the undisputed element must be paid in full and on time.
- Accuracy of Information. The Client confirms that all information supplied is accurate, complete and truthful and accepts responsibility for any consequences arising from incorrect or misleading information.
- Indemnity. The Client shall indemnify and hold harmless UKB, its directors, shareholders, employees, agents and contractors against all claims, losses, damages, liabilities, costs and legal proceedings arising out of or in connection with the instruction.
- Client Directions. The Client shall indemnify UKB against any additional costs or liabilities incurred as a result of specific instructions or directions given by the Client during the course of the instruction.
- Cancellation or Withdrawal. If an instruction is cancelled or withdrawn after acceptance, the Client agrees to reimburse UKB in full for all fees, costs and disbursements incurred up to the point of cancellation.
- Late Payment. UKB reserves the right to charge interest on overdue sums at 8% above the Bank of England base rate, together with any reasonable costs incurred in recovering unpaid amounts.
- Complaints. UKB aims to provide a high standard of service. Any complaints should be raised in the first instance with the Client Services Team at help@ukbailiffs.org.
- Data Protection. By submitting or signing an instruction, the Client confirms that they act as data controller and have a lawful and legitimate interest in providing the personal data supplied, in accordance with applicable data protection legislation.
- No Guarantee of Outcome and Authority to Stand Down.
UKB does not guarantee
that any attendance, action or instruction will result in the removal of trespassers, unauthorised occupiers,
vehicles, caravans or property, nor that vacant possession of land will be achieved. All services are provided on a best-endeavours basis only, subject at all times to legal constraints, site conditions, occupier behaviour, safety considerations, third-party intervention, and the directions or requirements of statutory authorities.UKB reserves the absolute right to delay, suspend, modify or stand down from an instruction where, in UKB’s reasonable opinion, it is necessary or appropriate to do so, including (without limitation) where:
- the police, local authority or other statutory body advises or directs UKB to stand down or not proceed;
- there is a risk to the safety of UKB personnel, occupiers or third parties;
- new information arises affecting the lawfulness or viability of the instruction; or
- access is denied or site conditions prevent lawful attendance.
In such circumstances, no refund shall be due in respect of fees, attendance costs, deposits or disbursements incurred, and UKB shall have no liability for any delay, non-completion or outcome of the instruction.
