When you can make a statutory demand
What is a Statutory Demand?
A statutory demand is a formal request for payment of a debt owed by an individual or company. It is a legal tool used by creditors to recover debts efficiently without necessarily requiring a lawyer.
Any creditor owed £750 or more can issue a statutory demand if previous attempts to collect the debt have failed. The debtor has 21 days to either:
- Pay the debt in full
- Reach an agreement with the creditor to settle the debt
If the debtor does not respond within 21 days, the creditor may apply to bankrupt the individual or wind up the company. Note that debts over 6 years old are generally not eligible for a statutory demand.
How to Serve a Statutory Demand
Serving a statutory demand involves delivering the form to the debtor in one of the following ways:
- Handing it directly to the individual debtor at any of their known addresses
- Delivering it to the registered office or main place of business of a company or partnership
- Giving it to a company director, secretary, manager, or principal officer
- Engaging a professional process server to deliver it
If in-person delivery is not possible, the demand may be sent by registered post or placed through a letterbox as a last resort.
