Vulnerable Situations Policy


Introduction


At UK Bailiff Services, we recognize our responsibility to safeguard vulnerable individuals during the enforcement process. This policy outlines our commitment to identifying and addressing vulnerable situations with discretion, compassion, and respect for the welfare of all parties involved.


Policy Statements


1. Recognition of Responsibility: UK Bailiff Services acknowledges that both our company and creditors share a responsibility to protect vulnerable and socially excluded individuals during the recovery process.


2. Establishment of Procedures: We will establish clear procedures in collaboration with creditors to address vulnerable situations effectively. These procedures will ensure that discretion is exercised appropriately in each case, recognizing that guidance cannot cover every scenario.


3. Communication and Reporting: It is the duty of our enforcement agents to promptly communicate with the creditor and report any circumstances indicating potential vulnerability or cause for concern.


4. Advice to Creditors: Our enforcement agents will advise creditors on further actions if deemed necessary, prioritizing the protection of debtors and avoiding actions that could be perceived as inappropriate.


5. Withdrawal from Premises: Enforcement agents will withdraw from residential premises if the sole occupant appears to be under 16 or is identified as vulnerable. In cases where only children under 12 are present, agents will withdraw without further inquiry.


6. Definition of Vulnerability: A debtor may be considered vulnerable if, due to age, health, or disability, they are unable to safeguard their own welfare or that of their household members.


7. Clarity in Agreements: Our enforcement agents will ensure that debtors or individuals entering into controlled goods agreements fully understand the terms and consequences involved.


8. Awareness of Hidden Vulnerability: Enforcement agents will remain aware that vulnerability may not always be immediately obvious and exercise caution in assessment.


9. Inclusive Support: We recognize that vulnerability can manifest in various forms. While specific groups are listed for reference, care will be taken to assess each situation on a case-by-case basis.


10. Access to Support Services: UK Bailiff Services will ensure that mechanisms are in place to rapidly access interpretation services, and provide information in alternative formats such as large print upon request for individuals with visual impairments.
