Vulnerable Situations Policy

Introduction

At UK Bailiff Services, we recognise our responsibility to safeguard vulnerable individuals during enforcement. This policy outlines how we identify and respond to vulnerability with discretion and respect.

Policy Statements

  1. Recognition of Responsibility: Both UK Bailiff Services and creditors share a duty to protect vulnerable individuals during recovery.
  2. Establishment of Procedures: Procedures will be defined with creditors, ensuring discretion is exercised case-by-case.
  3. Communication and Reporting: Enforcement agents must promptly inform creditors of any signs of vulnerability.
  4. Advice to Creditors: Agents will recommend alternative actions where vulnerability is identified.
  5. Withdrawal from Premises: Agents will leave if the only occupant appears under 16 or vulnerable. Agents must withdraw if only children under 12 are present.
  6. Definition of Vulnerability: A person is vulnerable if they cannot protect their welfare due to age, health or disability.
  7. Clarity in Agreements: Agents must ensure debtors understand any controlled goods agreements.
  8. Awareness of Hidden Vulnerability: Not all vulnerability is visible; agents must act with caution.
  9. Inclusive Support: Situations must be reviewed case-by-case beyond specific vulnerable groups.
  10. Access to Support Services: Interpretation and alternative formats (e.g., large print) will be made available where required.
